Terms and Conditions of Sale (CGV)

1. Scope

These Terms and Conditions of Sale ("T&Cs") govern all sales made through the e-commerce website "abris-jardin" (the "Website"). By placing an order on this Website, you agree to be bound by these T&Cs without reservation.

2. Products

The Website offers garden shelters, outdoor storage units, and related products. Product descriptions, specifications, and images are provided for informational purposes only. We make every effort to ensure accuracy, but minor variations may occur.

3. Prices

All prices are displayed in the currency indicated on the Website and include applicable taxes (VAT) unless otherwise stated.

Delivery charges, when applicable, are specified before order confirmation.

abris-jardin reserves the right to modify prices at any time; however, products will be invoiced based on the price in effect at the time of order confirmation.

4. Orders

An order is considered confirmed once payment has been successfully processed and a confirmation email has been sent to the customer.

abris-jardin reserves the right to refuse or cancel any order in the event of suspected fraud, payment authorization failure, or product unavailability.

5. Payment

Payments are processed securely through Stripe. By placing an order, you authorize Stripe to charge the total amount of your purchase to your selected payment method.

abris-jardin does not store or have access to your full payment card details. All payment data is encrypted and handled in accordance with Stripe’s security standards and applicable regulations.

Accepted payment methods are displayed at checkout. Payment must be made in full at the time of order.

6. Delivery

Products are delivered to the address provided by the customer during checkout.

Estimated delivery times are indicated for informational purposes only and may vary depending on location and availability.

abris-jardin shall not be held liable for delays caused by carriers or events beyond its reasonable control.

The customer is responsible for verifying the condition of the goods upon delivery and reporting any visible damage within 48 hours.

7. Right of Withdrawal

In accordance with applicable consumer protection laws, customers have the right to withdraw from their purchase within fourteen (14) days from the date of receipt of the goods, without providing any reason.

To exercise this right, the customer must notify abris-jardin in writing before the withdrawal period expires.

Products must be returned in their original condition and packaging. Return shipping costs are borne by the customer unless otherwise required by law.

Refunds will be issued using the original payment method within fourteen (14) days after receipt and inspection of the returned goods.

8. Legal Guarantees

Products sold on the Website are covered by applicable legal guarantees, including the legal guarantee of conformity and the guarantee against hidden defects, in accordance with applicable laws.

In case of a defective or non-conforming product, the customer may request repair, replacement, or refund as provided by law.

If a dispute arises regarding payment processed via Stripe, the customer agrees to first contact abris-jardin to seek an amicable resolution before initiating a chargeback or formal dispute.

Nothing in these T&Cs excludes or limits liability where such limitation is prohibited by law.

11. Applicable Law

These T&Cs are governed by and construed in accordance with the laws applicable in the seller’s country of establishment, without regard to conflict of law principles.

Any dispute arising under these T&Cs shall be subject to the jurisdiction of the competent courts, unless otherwise required by mandatory consumer protection laws.
